END-USER LICENSE AGREEMENT

1. Agreement

This Agreement is between Aaron Venture and you (“User”), and it is applicable for any usage, purchase or download of any sample libraries, virtual instruments or software (collectively referred to as “Software”) made by Aaron Venture. All rights not expressly granted in this agreement are reserved. Before using, purchasing or downloading Software made by Aaron Venture, read this EULA carefully.

2. Acceptance

By using, purchasing or downloading Software made by Aaron Venture, you are accepting the terms and agreeing to be bound by this Agreement, which will remain in effect until it is terminated.

3. License

You are granted a commercial, personal, non-transferrable, terminable, royalty-free license to use Software made by Aaron Venture worldwide for derivative works. You may use Software on multiple machines, provided you are the only one using them. The license forbids re-sale or re-distribution of Software in part or in whole, as well as usage of Software in other sample library products or virtual instruments. Aaron Venture remains owner of Software and copies thereof. For Site Licensing, anyone can use Software on the licensed machines within terms described above.

4. Termination

This Agreement will be terminated upon breaching any term. Upon termination, you shall immediately delete and stop all use of Software.

5. Refunds

You can request a refund within 14 days of your order if you have not downloaded or attempted to download your product. Due to the nature of downloadable products, once you have clicked on the download link or 14 days have elapsed, you acknowledge and agree that all payments made for Samples are non-refundable. You acknowledge and agree that no payments shall be refunded in case of Agreement termination.

6. Limitation of liability and indemnity

The software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall Aaron Venture be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.

You agree to use Software at your own risk. You agree to always defend, hold harmless and indemnify Aaron Venture with respect to any damage or loss, attorneys’ and experts’ fees, court costs, given that any such claim arises out of any breach of this Agreement. If found liable for any connection to this Agreement, you acknowledge and agree that the liability of Aaron Venture to you shall be limited to the amount you paid for Software.

7. Endorsement

Unless explicitly stated otherwise, Aaron Venture does not endorse, and disclaims any and all liability in relation to third-party materials and content created or exhibited by Users of Software.
